MarketCash Terms & Conditions

These MarketCash Terms & Conditions ("MC Terms") govern the MarketCash loyalty program ("Program") offered by MarketPay LLC ("MarketPay," "we," "us," or "our"), a Michigan limited liability company. By earning, holding, or using MarketCash, you agree to these MC Terms in addition to the MarketPay Terms of Service.

1. Program Classification

MarketCash is an on-platform loyalty and rewards program. MarketCash credits are promotional benefits with no cash value. MarketCash is not:

  • Cash, legal tender, or a cash equivalent
  • A stored-value product or prepaid instrument
  • Electronic money (e-money) or digital currency
  • A financial instrument, security, or investment product
  • A deposit, escrow, or trust account
  • Property or an asset of the user

MarketCash confers no property rights, ownership interests, or entitlements of any kind to the user.

2. Earning MarketCash

Users may earn MarketCash through qualifying activities as determined by MarketPay, including but not limited to receiving a percentage-based cashback credit on completed purchases processed via Stripe. The current earn rate is 5% of the card-charged amount. MarketPay may change the earn rate or earning criteria at any time without prior notice.

MarketCash is earned only upon successful completion of a transaction. Pending, disputed, refunded, or cancelled transactions do not qualify for MarketCash.

3. Using MarketCash

MarketCash may be applied toward eligible purchases on the MarketPay platform, subject to seller acceptance. Not all listings accept MarketCash. The availability of MarketCash as a payment option is determined on a per-listing basis by the seller.

When a buyer uses MarketCash, the seller receives an equivalent MarketCash credit to their balance. Sellers receiving MarketCash are subject to the same terms and restrictions described herein.

4. Non-Redeemable & Non-Transferable

MarketCash credits are strictly non-redeemable and non-transferable. Without limitation, users may not:

  • Withdraw MarketCash from the platform in any form
  • Convert MarketCash to cash, check, wire transfer, bank deposit, cryptocurrency, or any other form of payment or value
  • Transfer, gift, sell, trade, barter, or assign MarketCash to any other person, account, or entity
  • Use MarketCash outside of the MarketPay platform
  • Request a refund of MarketCash in cash or any other medium of exchange

Any attempt to circumvent these restrictions may result in forfeiture of MarketCash balance and account suspension.

5. Expiration

All MarketCash credits expire three hundred sixty-five (365) days from the date of issuance. Expired credits are automatically and permanently removed from the user's balance. MarketPay provides no compensation, extension, refund, or credit for expired MarketCash under any circumstances.

MarketPay may modify the expiration period at its sole discretion. Any such changes will apply to newly issued credits; existing credits will retain the expiration period in effect at the time of issuance.

6. No Guarantee of Value or Availability

MarketPay makes no representations, warranties, or guarantees regarding the future availability, value, utility, or acceptance of MarketCash. The Program is offered on an "as-is" basis. MarketPay shall not be liable for any loss, damage, or inconvenience arising from changes to or discontinuation of the Program.

7. Program Modification & Termination

MarketPay reserves the right, at its sole discretion, to modify, suspend, or terminate the MarketCash Program in whole or in part at any time, with or without notice. This includes the right to change earn rates, expiration periods, redemption rules, eligible transactions, and any other aspect of the Program.

In the event of Program termination, MarketPay may, at its discretion, provide a reasonable wind-down period during which existing balances may be used. MarketPay is under no obligation to do so.

8. Forfeiture

MarketCash balances are automatically and irrevocably forfeited upon:

  • Termination or suspension of the user's MarketPay account for any reason
  • Violation of the MarketPay Terms of Service
  • Fraudulent activity, abuse of the Program, or any attempt to manipulate MarketCash balances
  • Expiration of credits as described in Section 5
  • Termination of the Program as described in Section 7

Forfeited MarketCash cannot be recovered, reinstated, or compensated in any form.

9. Limitation of Liability

To the fullest extent permitted by law, MarketPay's total liability arising from or related to the MarketCash Program shall not exceed the amount of MarketCash credits at issue. In no event shall MarketPay be liable for any indirect, incidental, special, consequential, or punitive damages arising from the Program.

10. Governing Law

These MC Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles. Any dispute arising from or relating to these MC Terms shall be subject to the exclusive jurisdiction of the courts located in Michigan.
