Terms of service
These are the terms for using Marketpay, a free service operated by Intuzu (“we”). By using Marketpay you agree to them. They are short because the product is free and the deal is simple.
1. What Marketpay is
Marketpay is management software for markets: a public market page, vendor applications, booth assignment, market-day check-in, announcements and reminders, delivered as a web app at app.marketpay.app with public pages at marketpay.app. It is provided free of charge, with no seats or tiers. Our public commitments are on the promises page, and those commitments are part of these terms.
2. Your account and your co-organizers
You can use Marketpay without creating an account. If you attach an email address, you are responsible for keeping access to that inbox secure. If you invite co-organizers, you are responsible for what they do inside your organization. You must be at least 18 and using Marketpay to run a market or similar event.
3. Your data and your vendors’ data
Everything you enter into Marketpay belongs to you. You give us only the permission needed to store it, back it up, show the published parts on your public page, display the rest to the people you authorize, and send the emails the product is built to send. We do not sell it and we do not use it for anything else. You can export it at any time. See the privacy policy for details.
Vendor applications contain other people’s contact details. You agree to use them only to run your market, to keep them reasonably private, and to honor a vendor’s request to be removed.
4. Your public page
When you publish a market, its page and vendor list become public and are listed in the markets directory, and search engines may index them. You are responsible for what you publish: that it is accurate, that you have the right to publish it, and that the vendors you list are ones you have approved. Unpublish at any time to take it down.
5. Booth fees
Marketpay does not process payments. Any booth fee you show on your page is between you and your vendors, collected however you choose. The paid checkbox in the app is a note to yourself and nothing more.
6. Email
Marketpay sends email to vendors on your behalf: application confirmations, decisions, portal links, the announcements you choose to send, cancellations and day-before reminders. You agree to send announcements only to vendors of your own market about that market, and to comply with the laws that apply to you (for example, CAN-SPAM in the United States). We limit how much email an organization can send so the service stays trustworthy for everyone.
7. Acceptable use
Do not use Marketpay to break the law, to harass anyone, to send spam, to publish a market that does not exist, to store data you are not entitled to, or to attack, overload or reverse-engineer the service. We can suspend or remove an organization that does, and we will tell you why.
8. Free means free, and “as is”
Marketpay is provided free, as is and as available. We work to keep it reliable, but we make no warranty that it will be uninterrupted or error-free, and we are not liable for lost profits, lost data or indirect damages arising from its use, including a reminder that did not send or a page that was briefly down on market morning. To the extent any liability cannot be excluded by law, it is limited to US $100. Nothing here limits liability for fraud or for anything the law does not allow us to limit.
9. Changes and ending
You can stop using Marketpay at any time; export your data first if you want it. We can change the product, and these terms, with notice in the app. If we ever had to shut Marketpay down, we would give at least 90 days’ notice and keep export working until the end. We will not introduce per-organizer pricing or paid tiers for existing features; that is a promise, not a term we reserve the right to change.
10. The legal bits
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If a court finds part of these terms unenforceable, the rest still applies. These terms, the promises page and the privacy policy are the whole agreement between us about Marketpay.
